Tony, I prefer to discuss complicated matters in writing not by phone. Planning and Zoning is a land use agency in Town. The land use administrator is Karen Nelson. The Town clerk cannot refuse to file deeds on the land records. It is the responsibility of the recording attorney or responsible  party to assure accuracy and legality of records  through due diligence including title searches. You are the owner of record of 13 acres on Cook Rd. I believe field cards have been sent to you as well as an opinion from the Town’s attorney discussing the situation. Who is responsable for planning and zoning.

Why did the town alow transfer of the property if it was not sub divided.

Who is on record with the town as owner of 85 cook rd.

What is the legal discription of 85 Cook Rd.

Does the town fell they have any responsability in correcting the issue.

Tony, After looking into 85 Cook , I believe a lot of the confusion is caused by the fact that there was no P and Z  approved subdivision of the 13 acres from the original 75 acre lot. At the beginning of the year I purchased the property 85 Cook Road in Cornwall. I spoke to you on two previous occasions.

Shortly after purchasing the property I received a tax bill for the entire 75 archers, of which I thought I only purchased 13. I spoke to the tax collector and informed her that the taxes were supposed to be paid by the seller, I was waiting for the property to be reassessed. I was informed that she would look into it and bet back to me if there were any issues.

Three months later I received a letter from the tax collector stating a lean was being put on my property for failing to pay the taxes and a late fee was added. 

I went down to town hall and was told three different stories. The tax collector told me to talk to the assessor, the assessor told me to talk to planning and zoning. Planning and zoning told me to contact a layer.

I paid the full taxes on all 75 archers. Eventually the tax collector called me and said she got in touch with the seller and they were going to pay the taxes. She would send me a form and I could request a refund.

She still hasn’t gotten back to me, and I never received the form.

 

She was going to talk to you and the town’s attorney about the subdivision. She refused to give me the town’s attorney’s name.

Since I am being charged taxes on all of the 75 archers, I am laying claims to the property, all 75 archers.

I called Karen to make sure the property could not be subdivided without my knowledge, because someone should reimburse me for the taxes. Karen couldn’t give me a straight answer

 

There are other issues with Karen about my right of way on cook road and my ability to clear trees and make the road passable.

I am sure she will bring these to your attention.

I would appreciate if you can look into these matters for me. Do these people have bosses, I would like to escalate these issues to them?

PS: The town clerk the building inspector went out of their way to help me.
