I do not have notes or reports as I did not need to prepare those for the scope of testimony. What I can attest to is that I was contacted by plaintiffs counsel when Attorney Harvey excused himself from the case and was asked to offer my opinion on this issue already investigated. I visited the Cornwall Town Clerks Office on several occasions to research this issue myself, recheck his findings and form my own opinion, which is in agreement with his interpretation.

 

We can prepare an affidavit as to what I had done and attach his affidavit. If they want to depose me or if I’m required to appear in court well that’s how it goes. I think it unnecessary and wasteful; the record speaks for itself.

      I am counsel for Tony Macciaroli.  I have disclosed documents to them as you indicated, and they are claiming it is not enough.  I want to end this ... so will you sign an affidavit that indicates that you are relying exclusively on the information provided by Elton Harvey and I have disclosed that information already?  When can you talk?
