Phil, heres the retainer I looked at the title work its an extensive search he really went way back and basically found practically nothing regarding access. I think
we can use it and Buds work. Ill just have to get all the copies from both of these docs unless you have them because I will need to verify and double check their findings, which are likely to be relatively accurate as there is little there about access. I
don’t expect any new findings. Back in the 1800 and early 1900’s access wasn’t as concerning as it is today. Most people were just walking around on undeveloped land and knew all their neighbors. Many properties were landlocked because of this especially properties
which had topography challenges and as time went on no access to utilities. The title guy who did this letter (there is no date or name on it) did not come to a conclusion on access he was only reporting the Land Record findings. If the argument regarding
the defective road abandonment fails, you will have to argue prescriptive easement or easement by necessity as I do not believe there will be deeded access found we would have long known by now if there was. Ill need to do a search on the complaining abutters
property also. From a Land Records perspective this is not complicated it is what it is by the deeds. Its the outside abandonment issue and its effect and the parties themselves that have created the complexity.
